NOVIQ FIT gives general workout plans. It is not medical advice and does not replace a doctor, physiotherapist or personal trainer. The 14-day pilot is free and needs no payment details.
1. Who we are
NOVIQ FIT is provided by , , registration number (“we”, “us”). Contact: info@noviqfit.com.
2. The service
NOVIQ FIT is a workout planner for gyms. A gym (“customer”) places a QR code in its facility. Gym members (“users”) scan it and receive a workout built from that gym’s equipment. Users do not pay for the planner and do not need an account.
3. Health and safety
- The planner provides general information about exercise for healthy adults. It is not medical advice, diagnosis or treatment, and it does not replace a doctor, physiotherapist or qualified trainer.
- Check with a doctor before starting to exercise if you have a medical condition, an injury, are pregnant or are unsure whether exercise is safe for you.
- Choose weights you can control, follow the gym’s rules and instructions for its equipment, and stop if you feel pain, dizziness or discomfort.
- The gym is responsible for the condition and safe use of its equipment and facility.
- The planner is intended for adults. Anyone under 18 should use it only with supervision of a parent or a qualified trainer.
4. Free pilot for gyms
We may offer a gym a free pilot for 14 days. No payment details are needed. Either side can end the pilot at any time, and the gym can stop simply by removing the QR poster. Continuing after the pilot requires a separate agreement on a subscription.
5. Subscriptions
Paid subscriptions are agreed with each gym in writing, including the price, the billing period and the locations covered. Unless agreed otherwise, subscriptions are billed monthly in advance and can be cancelled at any time with effect from the end of the current billing period. We will give at least 30 days’ notice of any price change. Refunds are described in our Refund policy.
6. What gyms agree to
- To give us an accurate list of their equipment and tell us when it changes.
- That they have the right to use the logo and name they send us, and that we may show them in their planner. We use a gym’s name or logo in our own marketing only with the gym’s permission.
- To place the QR code where members can use it safely.
7. Acceptable use
You may not use NOVIQ FIT unlawfully, interfere with its operation, attempt to gain unauthorised access to it, or copy its exercise database, texts or design for your own product.
8. Intellectual property
The planner, its exercise database, texts, design and the NOVIQ FIT brand belong to us. Gyms keep all rights to their own names and logos.
9. Availability and changes
We work to keep NOVIQ FIT available and accurate, but we provide it as it is and cannot guarantee it will always be uninterrupted or free of errors. We may improve and change features over time.
10. Liability
To the extent permitted by law, we are not liable for indirect or consequential losses. For gym customers, our total liability under these terms is limited to the amount the gym paid us in the 12 months before the claim. Nothing in these terms limits or excludes liability that cannot be limited or excluded by law, including liability for death or personal injury caused by negligence, for fraud, or for intentional or grossly negligent conduct. If you use NOVIQ FIT as a consumer, you keep all rights you have under the mandatory consumer law of your country.
11. Privacy
How we handle personal data is described in our Privacy policy.
12. Changes to these terms
We may update these terms. For gym customers, we will give notice of material changes by email before they take effect. The date at the top shows the latest version.
13. Governing law
These terms are governed by the laws of the Republic of Latvia, and disputes are decided by the courts of Latvia. This does not take away protections that mandatory law in a consumer’s country of residence gives them.
